Theoretical Aspects Regarding the Recognition and Execution of Court Decisions in Civil Matters in the light of the Provisions of Regulation no. 44/2001
Abstract
An important role in simplifying formalities regarding the recognition and enforcement of court decisions was played by the adoption at community level of EC Regulation No. 44/2001 on jurisdiction, recognition and enforcement of judgments in civil and commercial matters, which enshrines the principle of automatic recognition of court decisions handed down in the member states of the European Union. This simplification, in a first stage, will serve to eliminate the exequatur procedure. The ultimate goal is, in fact, the creation of a unitary European legal space in which the free movement of decisions is also integrated.
